The closing costs nobody warns you about on a sponsor unit

Buying new construction from a developer moves costs onto you that a resale never would. Almost all of it is contract language.

On a resale, the seller pays the transfer taxes. On a new development purchase from the sponsor, the standard contract usually pushes them to the buyer. That single clause can be the largest surprise on your closing statement.

The pieces to know.

New York State transfer tax and the New York City real property transfer tax are normally seller obligations by statute, but a sponsor contract can shift the economic burden to the buyer. When it does, you also owe tax on the value of the taxes you are paying, because the assumed obligation counts as consideration. Your attorney should compute the grossed up figure, not the headline rate.

The mansion tax is a buyer tax on residential purchases of 1 million dollars and up, and it is tiered. It is not a marginal calculation. The rate for your bracket applies to the entire price, so crossing a threshold costs more than the dollar that crossed it. Our closing cost calculator has the full tier schedule built in.

Mortgage recording tax applies if you finance, and it is calculated on the loan amount, not the purchase price. The interest rate is irrelevant to it.

Sponsor legal fees. Many new development contracts have the buyer pay the sponsor's attorney fee. It is a real line item.

Working capital contribution. Typically a contribution of one to two months of common charges to the building's reserve. Non refundable and not a credit toward anything.

What is negotiable. More than people think, and less than people hope. Whether transfer taxes stay with the buyer is a commercial term, and in a slower market sponsors have taken them back or credited them. Sponsor legal fees are sometimes waived. The mansion tax and the recording tax are statutory and are not going anywhere.

The practical approach. Ask for a written estimate of closing costs from the sponsor before you sign, not at the walk through. Then run your own number independently. If those two do not match, the difference is the conversation you should be having.
